A Letter to the HOA Board About the Newly Proposed Development

Below is an outline of the activities being planned by The Garden City Council and the Garden City P&Z Committee. Many neighbors who are members of The Plantation Master Association feel that promises made by the City Fathers and the developer have been broken regarding the Fair Oaks access to the project. We respectfully request that the HOA Board inform themselves of the issues regarding these projects and that they actively join homeowners in addressing and opposing these actions. Please inform us of your plans for defending the homeowners who are most impacted by these projects.

Specifically does The Plantation Master Association plan on defending neighbor’s property rights as applicable to the golf course property. We would invite the HOA to join us once again in defending our neighborhood. Your answer will help direct us in how we will proceed in opposing this project that can only have a negative impact on our quality of life and property values.

Below are notes from our attorney regarding our concerns:

  1. THE CITY ATTORNEY DID ADD MR. LEROY’S OBJECTION LETTER AS PART OF THE PACKAGE----WITHOUT COMMENTS.

  2. THE IDAHO TRANSPORTATION DEPARTMENT MAKES NO COMMENTS!  

  3. THE FLOOD CONTROL DISTRICT REQUESTS NORTH RIVERBANK ACCESS BUT MAKES NO OBSERVATION ABOUT FLOODING CONCERNS. NO FEDERAL FOOD-RELATED AGENCY HAS COMMENTED.   

  4. THE NORTH ADA FIRE DISTRICT, IN IT'S APRIL 8TH REVISED LETTER, PARAGRAPHS 4,11 AND 12 DISCUSSES THAT "THE EMERGENCY ACCESS POINT AT THE SOUTH OF THE COMPLEX (FAIR OAKS PLACE) WILL SUFFICE AS A SECONDARY EMERGENCY ACCESS" AND COMMENTS ABOUT THE TECHNICAL DETAILS REQUIRED FOR GATES, BOLLARDS AND OPENING MECHANISMS. NO BOISE OR OTHER FIRE DEPARTMENT COMMENTS ARE SUBMITTED.  

  5. THE APRIL 9, 2025, ACHD COMMENTS ASSUME AND REQUIRE THAT THE 42 FEET OF FRONTAGE ACCESS TO FAIR OAKS PLACE IS A DONE DEAL. SEE NOTES AND STATEMENTS ON PAGES 2, 3, 7 AND 10. THE DOCUMENT AT PAGE 7, PARAGRAPH 2.2 c, REPEATS ITS ADVOCACY FOR "PEDESTRIAN AND BICYCLE CONNECTIVITY AT THIS LOCATION." IT CONTINUES TO PROMOTE AND SUGGEST THAT THE BOISE FIRE DEPARTMENT SHOULD ADOPT THE "APPLICANT''S PROPOSAL FOR THE 20-FOOT-WIDE EMERGENCY-ACCESS ONLY DRIVEWAY" AND THAT GARDEN CITY SHOULD APPROVE IT. ACHD SAYS ONLY IF THE EMERGENCY ACCESS IS NOT APPROVED, THEN THE APPLICANT SHOULD BE "PROHIBITED FROM TAKING VEHICULAR ACCESS FROM FAIR OAKS PLACE." REFERENCES ON PAGE 11, PARAGRAPH 9 DISCUSS VARIOUS STANDARDS FOR SHARED USE PATHS, BICYCLE FACILITIES AND TRAILS FOR ACCESS WHICH PRESUMABLY ACHD HAS IN MIND ALSO WHEN PROMOTING "CONNECTIVITY." FAIR OAKS PLACE IS COMPLETELY OPENED UP.  

  6. THUS, IT APPEARS THAT WE MUST FIGHT THE SAME BATTLES AGAIN. PROMISES SECURED BY THE WORDS OF THE CITY FATHERS, AND PROTECTED UNDER THE PLANTATION MASTER ASSOCIATION MASTER DECLARATION CONTRACT (MDC) NEED TO BE HONORED.
