Thank you for your support.

To our community,

John and I would like to personally thank you for your participation in and contributions to opposing the SAP application. We have a strong group of well informed, passionate residents who will not be pushed around by out-of-state owners and developers. Keep up the great work!

As you know, our attorney, Mr. David Leroy, and his team have been working diligently on researching, developing and delivering legal reasons why the SAP application should be denied by City Council. (Read his written arguments below.) At the most recent Planning and Zoning (P&Z) Commission hearing on April 27, 2023, many of those arguments were presented by both Mr. Leroy and you, concerned residents. It was a strong display of solidarity in opposition of the SAP application and we could not have done it without your support.

Two very important meetings are just around the corner:

May 24, 2023 at 5:30pm | P&Z Commission hearing

  • Accepting written comments until May 17, 2023.

  • UPDATE: The P&Z Commission voted in favor of the SAP application. City Council will now make the final decision.

June 12, 2023 at 6:00pm | City Council hearing

  • Includes public testimony

  • Garden City will accept letters to council members as long as they are received more than 7 days prior to a hearing.

  • Submit written comments and sign up for testimony using this Garden City form, and share your concerns before and at these upcoming meetings. Fill it out and send it to planning@gardencityidaho.org ahead of time.

  • UPDATE: On June 26, 2023, City Council voted in favor of the SAP application with some conditions. On July 10, 2023, Council Members voted to approve the decision document Garden City staff drafted, however, there are discrepancies, inconsistencies and ambiguities that need to be addressed. Please read Next Steps to learn more.

It is important to keep up the momentum we have created together. Part of that momentum includes continuing to retain our attorney, Mr. David Leroy, through the City Council decision should a decision lead to litigation. For this reason, we are asking for donations to help defray legal fees and ensure Mr. Leroy continues to represent us at all upcoming meetings.

If you would like to contribute, please email preserveplantation23@gmail.com for details.

Thank you for your consideration and your contribution. We wouldn’t be here without you.

Best,

Lynn and John Livingston
