RE: Settlement of Plantation Litigation Regarding Golf Course Property Rights

 

Settlement Announcement

The Plantation litigation, seeking a declaratory judgment on whether the Subdivision Master Declaration protects golf course land by requiring any proposed building thereon to comply with HOA design review procedures, has been settled. A mutual stipulation and dismissal have been entered with the court.

Terms of Settlement

The parties agreed that the HOA-passed amendment to the Master Declaration contract applies to the existing development, and the lis pendens was released.
The developers have compensated the Intervenor group with a monetary amount approximating the Objectors' costs and legal fees incurred during this litigation.

Existing Protections Remain in Place

Notably, the concessions won during the Garden City planning process remain in effect:

  1. Prevention of North Fair Oaks access from unwanted traffic.

  2. Measures to minimize density impacts on the existing neighborhood.

  3. Measures to minimize height impacts on the existing neighborhood.

These neighborhood protections continue to be enforceable under current city approvals.

HOA Collateral Benefit

The payment $500,000 to the HOA treasury by the River Club owners and associated developers also derived from the associated declaratory judgment action.
